Glenn Mulcaire has today won his claim for breach of contract, as a result of Rupert Murdoch’s declaration to the House of Commons Culture, Media & Sport Committee that News Group would withdraw the indemnity it had given him against costs and damages in the ‘phone hacking’ litigation. The Chancellor of the High Court ruled that News Group had contracted to indemnify Mr Mulcaire, that it had no right to terminate the indemnity, and that the contract was not contrary to public policy. Mr Mulcaire has been given permission to apply for specific performance in the event that his indemnity is not reinstated.
