In Premier Roofline Installations Ltd v TK Products (Trade Counter) Ltd [2019] (TCC), Gethin Thomas successfully acted for the Responding Party to an application to enforce an adjudicator’s decision concerning oral contracts. HHJ Pearce QC, sitting as a High Court Judge, applied recent caselaw concerning the enforcement of adjudication decisions in respect of oral contracts (M Hart Construction Limited, P K Maintenance Limited v Ideal Response Group Limited [2018] EWHC 314 (TCC) and RCS Contractors Ltd v Conway [2017] EWHC 715 (TCC)), and held that he could not conclude that the Responding Party had no prospects of successfully defending the enforcement claim.
