Fenella Morris QC and Kelly Stricklin-Coutinho act in Tempus Energy judicial review on state aid

Tempus Energy filed a judicial review claim against BEIS, alleging that it had failed to suspend the Capacity Market, despite the EU General Court's annulment of the European Commission's 2014 decision that the arrangements complied with State aid law.

In February 2019, the European Commission announced an in-depth investigation to determine whether the UK's Capacity Market arrangements are in line with State aid law.  The outcome of that investigation is awaited.
