Environment Agency prosecutions under the transfrontier shipment of waste regime have generated three appeals to the Court of Appeal in the last six months on interpretation of this complex regime. Whilst the fines may not act as a deterrent the significant sums of money being sought by the Agency under the criminal lifestyle provisions of the Proceeds of Crime Act certainly are.
