Duncan Sinclair successfully defends Judicial Review challenge to QASA scheme in Divisional Court

A full Divisional Court today gave judgment dismissing the judicial review challenge to QASA, the new quality assurance scheme for criminal advocacy. Duncan Sinclair appeared with Nigel Giffin QC for the Legal Services Board, the Defendant, which had approved the introduction of the scheme. The court rejected arguments that the scheme would give rise to prejudice to the role of the advocate or the judges involved, and considered a number of arguments of wider interest, including the circumstances in which a test for proportionality would apply, and the application of ECHR A1P1 rights to potential loss of future income.
