Dispute avoidance and resolution under the FIDIC Rainbow suite of contracts

On February 18^th, 2020, Karen Gough delivered the following seminar on dispute avoidance and resolution under the FIDIC Rainbow suite of contracts, in Trinidad and Tobago.  The seminar looked at both the 1999 and 2017 editions.

The slides which she prepared as an outline for the seminar are a timely reminder of the available provisions under both editions of the FIDIC forms.  In the current climate, parties will need more than ever to avail themselves firstly of the dispute avoidance provisions and, failing success, the dispute resolution provisions.  Parties and their representatives are also directed to the Guidance notes for clause 21 to the 2017 forms which provide for the appointment of ad hoc dispute boards and mediation in pursuit of amicable dispute resolution.
