Stephen Tromans QC is currently advising on the serious deterioration of river systems in the Broads special areas of conservation, in a case raising important issues of the proactive duty to prevent deterioration of such sites.  The complaint is of failure by the Environment Agency to take the necessary steps in the light of evidence of the risk of deterioration. An article in ENDS Report explains his advice and how this is consistent with recently published Government guidance on the proactive statutory duty.
