Given the restrictions on the recovery of secured debts as a result of Covid-19, more and more are turning to alternative remedies when debtors default on their obligations. David Sawtell has written about the different remedies that a mortgagee can employ to secure repayment, highlighting the most recent case law on the different considerations that can affect their decision making. He notes that more and more creditors are considering appointing receivers. This article first appeared in the December issue of Butterworths Journal of International Banking and Financial Law.
