Daniel Stedman Jones successfully wins Enforcement Appeal against Tower Hamlets Borough Council concerning a £1.5 million development of a former pub in Hackney. The Council sought to introduce concealment arguments drawing on Welwyn Hatfield Council v SSCLG [2011] UKSC 15 and the recent High Court case of Jackson v SSCLG [2015] EWHC 20 (Admin). The Inspector rejected the Council’s arguments ruling that the case law did not establish a broad principle that a person could not benefit from any wrongdoing. Notwithstanding certain inaccuracies and omissions in the planning process concerning the site, the lawfulness of the various dwellings had been proven for more than four years. The Inspector’s decision can be read below.
