To mark the third anniversary since the inception of the Court of Protection newsletter, the team have taken the opportunity to reflect the fact that the newsletter’s remit now ranges far beyond the Court of Protection. As such, from here on, it will be know as the Mental Capacity Law Newsletter.
To highlight this, the newly launched issue covers not just important decisions in the CoP about deprivation of liberty and marriage, but also such matters as the obligations upon solicitors concerned as to the testamentary capacity of their clients, a decision of HM Land Registry Adjudication Service and the new Irish Assisted-Decision (Capacity Bill).
The team is also pleased to be able to provide with this issue an article written by the Official Solicitor, Alastair Pitblado, on the decision of the Court of Appeal in (1) PC and (2) NC v City of York  EWCA Civ 478.
