Council’s special guardianship allowance model quashed by High Court
Victoria Butler-Cole QC represented the successful claimant in proceedings for judicial review of the mechanism used by Plymouth City Council to calculate payments to special guardians. The council’s model has been quashed because it did not provide a coherent way of taking account of the general household expenditure of special guardians. The council will now have to produce a new model, and recalculate the claimant’s financial allowance. The judgment will be of wider significance to other special guardians funded by Plymouth City Council, and potentially to other local authorities who have amended the DfES model for financial payments to special guardians.
