Duty of consultants to third parties



The Scottish case of McManus v. Scott Wilson Scotland Limited [2021] CSIH 37 involved a claim by residents of housing built on a former iron and steel works against the consultants who had advised in connection with the development of the site, and it was said had failed to deal with the risks of volatile compounds present in the soil. It was held that there was sufficient proximity to give rise to a duty of care on the part of the consultants to future residents who might be affected. However the claim failed on the facts, the nature of the duty not being as wide as had been contended.
