Following 18 months of consultation and road-testing the Disclosure Working Group announced on 31 July that final approval has been given for a two-year Disclosure Pilot scheme for cases in the Business and Property Courts. The Working Group had previously concluded that there are several key defects in the current disclosure regime, that “wholesale cultural change is required” and “this can only be achieved by the widespread promulgation of a completely new rule and guidelines.” The pilot of the new rules starts on 1 January 2019 and will be mandatory for nearly all B&PC cases.
