Nyasha Weinberg

Nyasha accepts instructions across all of Chambers’ practice areas with a particular focus on public law, regulatory and disciplinary law, commercial and construction law. 

Nyasha has a busy court practice appearing all levels up to the Supreme Court with particular expertise in health, regulatory, social care and education. She has a substantial inquiries practice. She is currently instructed in the Lampard Inquiry (on the Deaths of Mental Health Inpatients in Essex) and was Junior Counsel in the Infected Blood Inquiry and Grenfell Inquiry. 

She acts as junior counsel in construction adjudications and international arbitration and has undertaken secondments on data protection law and construction law. 

Before coming to the Bar, Nyasha worked as a civil servant, political advisor and management consultant. She has been widely published on devolution, the Rule of Law, international trade policy, UK-EU relations, technology and the future of work with her research cited by major UK and international newspapers. Nyasha maintains research affiliations with the Harvard Kennedy School, Bingham Centre for the Rule of Law and King’s College London. Nyasha accepts instructions on a pro bono basis.

Areas of expertise

Administrative and Public

Nyasha is developing a broad public law practice that also spans international public law. She is particularly interested in business and human rights, community care and mental health, education, civil liberties and human rights, local government, medical treatment and public international law. 

Her current and recent work includes: 

  • Advice to a Ukrainian museum on cultural heritage law in the context of the war in Russia
  • Arraf v NSW Crime Commission [2022] NSWCATAD 81: Nyasha acted for the applicants who sought to obtain information about actions taken by the NSW Crime Commission to effect the seizure and forfeiture of assets of an alleged ISIL fighter.
  • Drafting grounds of multiple judicial reviews, including in a Housing Act 1996 claim, illegality by a local authority in respect of the statutory assessment of the needs of disabled children 
  • Advice to a number of NHS Trusts and Healthcare Authorities on GDPR law
  • Advice to Local Authorities on Equalities Impact Assessments 
  • Drafting grounds and appearing as a junior in an Upper Tribunal case 
  • Drafting in Karanja, R (On the Application Of) v University of the West of Scotland [2022] EWHC 1520 (Admin) 
  • Regular SEND tribunal appearances

Prior to pupillage, Nyasha worked on a range of public law issues, including: 

  • Rule of law backsliding in Europe
  • Lead authority of a number of papers for the Bingham Centre for the Rule of Law
  • Writing for the UK Constitutional Law Association blog on constitutional law, technology and the Covid-19 pandemic
  • Writing for the EU Horizon 2020 Project Reconnect on Covid-19, good governance and the rule of law

Clinical Negligence and Personal Injury

Nyasha regularly appears in the County Court and High Court and has experience of trials, applications, Ministry of Justice (MOJ) Stage 3 proceedings, infant settlements, and costs case management conferences (CCMCs). She also has considerable experience drafting and assisting in large and multi-handed claims. Highlights include:

  • Successfully resisting a claim under the Animals Act 1971
  • Fundamental dishonesty allegations

Commercial

She has been instructed in a wide variety of commercial matters. Recent experience includes:

  • Successfully resisting PPI claims. 
  • Drafting particulars in a claim involving a breach of contract and tortious liability arising from an unlawful means conspiracy
  • Application for an injunction in the County Court to obtain access to a premises 
  • Draft defence and counterclaim joining a third-party guarantor under a tenancy agreement.

Construction

Nyasha regularly appears as sole counsel in adjudication and has been instructed by employers, contractors and consultants in disputes that range from multi-million pound defect cases to payment claims. Her experience includes: 

  • A five month secondment to a major construction law firm
  • A number of ‘smash-n-grab’ adjudications
  • A multi-million pound final account adjudication 
  • A significant issue involving a Health and Safety at Work etc. Act 1974 (HSWA) prosecution 
  • Junior counsel on a multi-million pound adjudication involving a major government body. 

Court of Protection and Medical Treatment

Nyasha appears regularly in the Court of Protection on both the Health and Welfare and Property and Affairs pathways. Nyasha is a regular contributor to the 39 Essex Mental Capacity Report. Nyasha acts for a range of parties in Court of Protection cases including the Official Solicitor including in complex cases concerning deprivation of liberty, forced marriage, coercion and control, mental health and learning disabilities. 

  • Junior to Alex Ruck Keene for the Mind the intervener in the Supreme Court in R (on the application of Worcestershire County Council) v Secretary of State for Health and Social Care [2023] UKSC 31 on ‘ordinary residence’ and s117 aftercare services
  • Junior to Parishil Patel KC in a complex forced marriage case. 
  • Five-day fact finding for a Local Authority in a coercive-control case.
     

Inquiries and Investigations

Nyasha is currently instructed as junior counsel to one of the core participants in the Infected Blood Inquiry.

Nyasha has drafted submissions, advice and recommendations for one of the core participants in the Grenfell Inquiry.

Regulatory and Disciplinary

Regulatory and disciplinary practice including Defence work in a major SRA professional disciplinary case and regular advice to the Professional Standards Authority for Health and Social Care.
