Camilla ter Haar

Camilla ter Haar has a broad practice which combines commercial and construction law and public inquiry work. She regularly acts in international and domestic matters for a range of public and private clients and their legal advisors. Camilla’s principal practice areas are in commercial and related litigation, including construction law. She is commonly retained by both the private and public sectors in pre-trial, interlocutory and trial appearances and to advise. She is experienced and efficient in working as a team member with those who instruct her.

Camilla has a significant practice in public inquiry work and is currently instructed as junior counsel to the Grenfell Tower Inquiry, led by Richard Millett QC and Kate Grange QC.

Commercial
Camilla has wide-ranging commercial experience and is experienced in acting in claims relating to the provision and supply of goods and services, both domestically and internationally and claims relating to breach of contract and actions to recover monies. Camilla provides advice on the validity of terms and conditions and exclusion clauses as well as tactics and jurisdiction.
Recent examples of Camilla’s commercial experience include:
- Arbitration: an international arbitration arising from a trade dispute between a British manufacturer and the Taiwanese government.
- Commercial Court: claim for unpaid invoices by a Saudi Arabian law firm against a German construction company.
- Chancery Division: Rowley v Dunlop [2014] EWHC 1995 Successfully resisted an application to strike out a claim based on the alleged inadmissibility of expert evidence.
- ICC Arbitration: multi-million pound claim and counter-claim arising out of infrastructure (water treatment) works in the Middle East, including defects and delay issues.
- ICC Arbitration: multi-million pound contract termination claim arising out of major Middle East infrastructure project.
Construction
Camilla’s specialisation in contractual and construction disputes is reflected in her co-authoring “Remedies in Construction Law”, published by Informa Law.
Camilla’s practice frequently requires her involvement in international and domestic construction disputes. Recent trials include a claim for damages for defective building work and for breach of contract in a construction contract.
Recent examples of Camilla’s construction and engineering experience include:
- ICC Arbitration: multi-million pound claim and counter-claim arising out of infrastructure (water treatment) works in the Middle East, including defects and delay issues;
- ICC Arbitration: multi-million pound contract termination claim arising out of major Middle East infrastructure project;
- Camilla is currently instructed as junior counsel to the Grenfell Tower Inquiry, led by Kate Grange QC and Richard Millett QC. Her focus has particularly related to façade construction, issues relating to fire spread, and testing and certification of materials.
International Arbitration
Camilla has experience of and expertise in international arbitration, particularly in relation to disputes arising out of construction and infrastructure projects.
Recent work includes:
- an international arbitration arising from a Qatari-based construction project;
- an international arbitration arising from a trade dispute between a British manufacturer and the Taiwanese government.
Public International Law
Camilla has advised extensively in relation to public international law matters, including:
- Provided advice regarding proposed women’s rights legislation in Sierra Leone.
- Advised One World Action with regards to a draft trade union law in Cambodia.
- Provided advice to ATT Legal with regards to non-governmental organisation (NGO) rights in the arms trade treaty negotiations.
- Recently advised EDLC on indigenous land rights with regard to a proposed Malaysian Land Rights bill.
- Advised the Western Sahara Campaign with regards to product labelling and the legality in international law of the practice of labelling produce originating from the non-self-governing territory of Western Sahara as Moroccan.
