Articles 2 (right to life) and 3 (prohibition of torture) of the European Convention on Human Rights (‘the convention’) rank as two of its most fundamental provisions, enshrining basic values of the democratic societies making up the Council of Europe. This paper looks at the investigative obligations arising from these articles and at recent developments in case law.
