Alex Ruck Keene appears in significant case involving transfer of foreign care proceedings brought following a tactical flight by the mother with the baby in utero.

This case concerns the transfer under the provisions of Article 15 Brussels IIR revised of Irish care proceedings which had been commenced in respect of a baby born to a mother whose sole (and stated) reason for being in Ireland was because she had fled there to avoid English care proceedings being brought in respect of the child.

The judgment is of significance for both the (novel) exploration of the public policy implications of jurisdictional flights and (equally novel) analysis of the relevant local authority in this jurisdiction with responsibility to act as applicant in the transferred care proceedings.
