The Planning Court opened on 7th April. The first claim to be filed in the Planning Court was R(Campaign for Real Ale) v Bradford Metropolitan District Council CO/1556/2014. This concerns a challenge by CAMRA to the grant of listed building consent for works to a public house. In pre-action correspondence the Council have agreed to submit to judgment, having previously submitted to judgment on an earlier consent. The claimant’s counsel is Richard Harwood QC.
The first hearing in the Court was the grant of permission to apply for judicial review of English Heritage’s decision not to designate land at Germany Beck, York on the Battlefields Register as the site of the 1066 Battle of Fulford: R(Jones) v English Heritage CO/1932/2013.
