Vikram Sachdeva QC successful in application for specific disclosure – documents not protected by Without Prejudice Privilege

EMW Law LLP v Halborg [2017] EWHC 1014 (Ch)

Mr. Justice Newey, sitting in the Chancery Division, upheld the decision of Master Clark to order specific disclosure of settlement negotiations with the opposing party in litigation, holding that it fell within an exception to the rules on Without Prejudice Privilege. This is an important ruling which clarifies the scope of the concluded agreement and Muller v Linsley exceptions to Without Prejudice Privilege.
