Timothy Lyons QC on the expert panel for the EStAL Intensive Workshop "Infrastructure Funding in Compliance with State Aid Law / State Aid for Rescue and Restructuring".

Timothy Lyons QC will chair a session at the European State Aid Law (EStAL) Intensive Workshop on 10th November 2016 at King's College London.

The session will be on State Aid for Rescue and Restructuring and will cover:

• Rescue and Restructuring Guidelines and recent judgements
• Recent Commission practice in application of the 2014 R&R Aid Guidelines
• Horizontal rules vs. new financial sectors' rules & lessons learnt
• Aid for rescue and restructuring for non-financial undertakings
• Assessment of aid: Counterfactual analysis, incentive effect and balancing test

The session will also discuss the Rescue and Restructuring Guidelines by exploring in depth the definition of a "Firm in Difficulty", the balancing test's new filters and the reformed rules on burden sharing and the restructuring temporary support. Furthermore,the assessment of restructuring aid will be analysed.
