Local Government Law Update 2007

Richard Clayton QC will present in Chambers an updated paper based on the highly popular lecture he gave at the Solicitors in Local Government Weekend School in March 2007.  He will cover recent developments in community care, education, environmental and planning, housing, judicial review, planning and local government law including:

  • Residential placement and Article 5
  • Recent developments on the law of bias
  • EIA and the European Court of Justice
  • Article 8 and licensees
  • Recent developments on fair consultation
  • Public authorities
  • Ethical standards.

Richard has a substantial advisory local government practice. Recent work has included advising on the vires of a PFI scheme and of an affordable housing scheme, data protection and Freedom of Information, election law, contaminated land and the power of well being, on constitutional issues/apparent bias, the vires of a local authority agreement to enter into a PPP to provide residential care; and issues arising out of the closure of a residential care home and advising on the DIP procedure in relation to the termination of a senior local government officer.

Recent cases include R (Scott) v Somerset County Council, a legitimate expectation claim concerning waste be to deposited on land fill facility which settled the night before 3 day hearing with claimants paying £60,000 towards costs and R (Buckinghamshire County Council) v Commission for Social Care Inspection, a major challenge to CSCI’s assessment of adult social services in which Richard is acting for the Council.
