Ministry of Justice v Carter
The claimant was an inmate in a closed prison who alleged that she had complained repeatedly to prison doctors of a breast lump and not received an adequate examination. The judge held that there had been a breach of the duty of care owed. The Court of Appeal reversed the decision after considering whether the judge had applied the correct tests of the duty owed and correctly evaluated expert evidence.
