Nicola Greaney represents George Eliot Hospital NHS Trust in a claim for damages

Nicola Greaney represented George Eliot Hospital NHS Trust in a claim for damages arising out of the failure by the Trust to follow an advance decision with the result that Mrs Grant received clinically assisted nutrition and hydration in contravention of her previously expressed wishes for a period of around 18 months.

The advance decision was contained in an old volume of medical records and was not noticed by medical staff. The Trust has now set up a new system for recording advance decisions. It is thought to be the first case where a negligence claim has been brought against professionals for failing to follow an advance decision.

Damages were agreed in an out of court settlement at £45,000.
