Sadie Crapper succeeds for paralysed claimant in road traffic accident case

Sadie succeeded in establishing primary liability against a van driver who caused a horrific accident leaving her client paralysed.  Judgment was handed down on 30 July 2019 following a three day liability only trial in early June in which Sadie Crapper acted as sole Counsel, instructed by Jenny Kennedy of Anthony Gold Solicitors, in this catastrophic injury case.  The Defendant had maintained a full defence of liability and argued for contributory negligence in excess of 50% given the Claimant's excess speed and an alleged deliberate decision to try to steer out of the problem created by the van driver's decision to change lanes.  Nicholas Braslavsky QC, sitting as a Deputy Judge of the High Court, found for the Claimant and deducted 25% for contributory negligence.  The Defendant's application to the trial judge for permission to appeal was refused.  The parties will now prepare quantum.
