Fenella Morris QC and Jack Anderson instructed by patients challenging Bootham Park Hospital closure secure judicial review

Fenella Morris QC and Jack Anderson, instructed by Irwin Mitchell, and acting for affected patients have secured permission to claim judicial review of the decisions of the CQC in relation to the closure of Bootham Park Hospital, York, in October 2015.

This appears to be the first claim for judicial review by patients of CQC decision-making in this context. The challenge contends that in exercising its powers in a manner that effectively led to the closure of the Hospital, the CQC acted without regard to relevant considerations, without a lawful consultation and irrationally.

The matter is likely to be heard in June 2016.
