What our members do

A number of our Court of Protection and Medical Treatment barristers are qualified mediators experienced in conducting mediations in a range of disputes, including urgent serious medical treatment disputes for both adults and children, and long-running multiparty welfare disputes.

Our barristers are experienced in supporting clients through the process of mediation in both issued cases and pre-issue cases. We are able to meet the particular challenges that arise when mediating cases about the health and welfare of a third party, including how best to elicit the wishes and feelings of the subject matter of the dispute and ensure their participation.

Who our members act for

Our mediators and barristers are instructed by a wide range of clients, including clinical commissioning groups, NHS trusts, local authorities, the Official Solicitor, advocates and family members.

Our team participated in the Office of the Public Guardian’s telephone mediation pilot scheme and were instrumental in designing and implementing the Court of Protection pilot mediation scheme.

Where our members act

Our barristers act in mediations all around the country and in a variety of locations, including hospitals.

We act in mediations that take place in person, virtually or using a combination of the two. We can also facilitate mediations from our premises in central London.
