HOT OFF THE PRESS: Paul v Wolverhampton – the Supreme Court decision

39 Essex Chambers is delighted to invite you to join our team as they discuss and reflect on the long-awaited Supreme Court decision on secondary victims, which was handed down on 11 January 2024.

Paul v Wolverhampton and conjoined appeals raise wide questions about secondary victims, remoteness and duty of care. Following our webinar in 2020 after the first instance decision, we reflect on the outcome of Paul as it clears the final hurdle.

Charlie Cory-Wright KC, Emily Formby KC and Scarlett Milligan will provide you with an early exploration of the decision and its implications.

We will look at definitions of proximity; timing between breach and consequence; hospital cases and causation; and reflect on what we have learnt from the judgment.

Paul and another (Appellants) v Royal Wolverhampton NHS Trust (Respondent).  Supreme Court case ID: 2022/0038.  Conjoined appeals with Polmear v Royal Cornwall Hospital NHS Trust and Purchase v Ahmed.  Court of Appeal decision appealed against [2022] EWCA Civ 12.
